Anti-Spam, Privacy, and Ethical Marketing Policy

Surge maintains strict standards for ethical communication and marketing practices. Every interaction shared under the Surge brand must respect privacy laws, maintain professionalism, and reflect our core values of transparency, trust, & integrity.

Purpose

Why This Policy Exists

This policy protects Surge members, partners, and clients from misleading, intrusive, or noncompliant marketing behavior. It ensures all communication aligns with federal and state marketing laws, including the CAN-SPAM Act, TCPA (Telephone Consumer Protection Act), and other applicable regulations.

Who Must Follow It

All Surge members, Scouts, Strategists, Mentors, and partners must follow this policy when promoting Surge, communicating with leads, or marketing energy solutions.


Anti-Spam Requirements

Consent

Always obtain clear permission before sending promotional or marketing communications. Do not email, text, or call anyone who has not opted in or expressed interest in learning about Surge or its services.

Identification

All messages must clearly identify you as an independent Surge representative. Include your full name and contact information in each outreach message or email footer.

Opt-Out Options

Every marketing message or automated email must include a clear way for recipients to unsubscribe or opt out from future communication.

Honoring Opt-Out Requests

Remove contacts who unsubscribe within five business days of their request. Never attempt to re-add them to a marketing list without documented re-consent.


Ethical Marketing Standards

Accuracy and Transparency

All claims about energy savings, performance, or financial benefits must be factual and verifiable. Avoid exaggerated or misleading statements about project timelines, incentives, or returns.

Honest Representation

Members must not represent themselves as Surge employees or imply partnership authority beyond their independent contractor role. Use only approved Surge marketing materials and templates for consistency and compliance.

Respect for Privacy

Never share customer data, email lists, or contact information outside approved Surge systems. Do not export or reuse lead information from the Surge platform for non-Surge-related purposes.

Professional Conduct

Use respectful, courteous language in all outreach, even if a prospect declines interest. Do not pressure, spam, or repeatedly contact leads who are unresponsive.


Digital and Social Media Use

Branding Guidelines

When posting on social media, use approved Surge logos, visuals, and messaging. Do not alter or remix official branding without written approval from the Surge marketing team.

Content Integrity

Refrain from posting exaggerated claims, political opinions, or unrelated personal promotions under the Surge name. All posts should reflect Surge’s brand tone: professional, solution-focused, and collaborative.

Use of Disclaimers

If you share personal results or client outcomes, include appropriate disclaimers (e.g., “Results vary by project size, location, and partner terms.”). Avoid using testimonials or case studies without verified results and permission.


SMS and Telemarketing Rules

Consent for Texting

Text messages may only be sent to leads who have explicitly opted in. Always include a clear STOP option for recipients to unsubscribe.

Respect for Calling Hours

Phone outreach should occur only between 9:00 a.m. and 8:00 p.m. local time of the contact. Do not use robocalls, auto-dialers, or prerecorded messages without written consent.

Use of Approved Systems

All outreach should occur through Surge’s authorized CRM and communication tools to ensure proper record-keeping and compliance.


Consequences of Violation

Any member found in violation of Surge’s Anti-Spam, Privacy, or Ethical Marketing policy may face disciplinary action, including:

  • Temporary or permanent account suspension

  • Loss of commissions or removal from the Surge platform

  • Reporting to regulatory authorities if laws are violated


Reporting Improper Conduct

If you observe unethical marketing behavior or receive a spam complaint:

  1. Report the details immediately to [email protected].

  2. Include the sender’s name, date, and a copy of the communication (if available).

  3. Surge leadership will review and address violations promptly.
